Then I guess reading the actual testimony from the hearings on the treaty that voiced the reasons not to ratify it would be fine reading for you then...

It isn't a conspiracy theory, it is how the constitution set up the effect of treaties on our laws. Read the testimony as to why it is a bad idea and you will see why.

I've heard some of the testimony. It's bizarre.

I personally have no use for the UN. Not until they pay all their outstanding parking tickets.

Even with what you found, this treaty would have the power of law, as long as it didn't violate the constitution. Since it doesn't directly do that, but still empowers judges here and requires actions by our government in relation to the U.N. all the problems mentioned in previous posts still stand. It would still be part of U.S. law actionable by judges and law makers here in the states.

For example...

Article 7 gives the government the power to override every decision of the parent of a disabled child by using the caveat "the best interest of the child." This phrase has already been abused by family courts to substitute judges' decisions for parents' decisions and transferring the use of that phrase to the government or to a U.N. committee is the wrong way to go.

This bypasses our guys actually coming up with the votes to pass it here, through both houses of the congress versus simple ratification by 2/3 of the Senate.

Also...

After ratification, treaties become part of the "supreme law" of the United States on a par with federal statutes. That gives supremacist judges the power to invent their own interpretations, which some are all too eager to do.

Treaties apply in instances where we have no applicable law on place. We do in this instance, and treaty does not override existing US law.


Plus, the fact that there is no enforcement mechanism in place in the treaty, means if we sign on that we agree with it, the UN can not do a thing if we (or anyone else for that matter) don't comply with it. Much like the strongly worded letters they send out. Instead of 'where's the beef?' with the UN it's like 'where's the teeth?'
